The website may only be used for its intended purpose. Except as may be otherwise indicated in specific documents within the website, you are authorized to view, play, print and download documents, audio and video found on our website for personal, informational, and noncommercial purposes only. You may not modify any of the materials and you may not copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer or sell any information or work contained on the website. Except as authorized under the copyright laws, you are responsible for obtaining permission before reusing any copyrighted material that is available on the website. Trademarks. All trademarks, service marks and trade names of Bark used on the website, including the Bark name, Bark logo, and Dog Is My Co-Pilot®, are trademarks or registered trademarks of Bark. You may not use, copy, reproduce, republish, upload, post, transmit, distribute, or modify Bark Marks in any way, including in advertising or publicity pertaining to distribution of materials on this site, without Bark’s prior written consent. The use of Bark Marks on any other website or network computer environment is not allowed. Bark prohibits the use of Bark Marks as a “hot” link on or to any other website unless establishment of such a link is approved in advance.
User Submission License. Where Bark has specifically invited or requested submissions, Bark encourages members of the public to submit user published content or user content (e.g. postings to forums or other services) to Bark (“User Submissions”). User Submissions remain the intellectual property of the individual user. By posting content on our website, you expressly grant Bark a non-exclusive, perpetual, irrevocable, royalty-free, fully paid-up worldwide, fully sub-licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, transmit, perform and display such content and your name, voice, and/or likeness as contained in your User Submission, in whole or in part, and in any form throughout the world in any media or technology, whether now known or hereafter discovered, including all promotion, advertising, marketing, merchandising, publicity and any other ancillary uses thereof, and including the unfettered right to sublicense such rights, in perpetuity throughout the universe. We are not responsible or liable for the conduct of website visitors or for views, opinions, and statements expressed in User Submissions for public display through our website, such as through a forum or other service. Generally, we do not prescreen information posted to online forums, user profiles or other services. Any opinions, advice, statements, services, offers, or other information in User Submissions expressed or made available on the website are those of the respective author(s) or distributor(s) and not of Bark. We neither endorse nor guarantee the accuracy, completeness, or usefulness of any such User Submission. You are responsible for ensuring that User Submissions to this website are not provided in violation of any copyright, trade secret, or other proprietary right of another person or entity. You shall be solely liable for any damages resulting from any infringement of copyrights, trade secret, or other proprietary rights, or any other harm resulting from your uploading, posting, or submission of User Submissions to this website.

Bark reserves the right to sell, license and/or display any advertising, attribution, links, promotional and/or distribution rights in connection with your creative submission, and Bark and its licensors or affiliates will be entitled to retain any and all revenue generated from any sales or licenses of such advertising, attribution, links, or promotional or distribution rights. Nothing in these additional terms obligates or may be deemed to obligate Bark to sell, license or offer to sell or license any advertising, promotion or distribution rights.
General Terms. We attempt to ensure that information on this website is complete, accurate and current. Despite our efforts, the information on this website may occasionally be inaccurate, incomplete or out of date. We make no representation as to the completeness, accuracy or currency of any information on this website. Nothing contained on this website should be construed as granting, by implication or estoppel, any license or right to use this website or any Content displayed on this website, through the use of framing or otherwise, except: (a) as expressly permitted by these Terms; or (b) with our prior written permission or the permission of the third party owner of the trademark, copyright or other proprietary right of the Content.

Any person determined by Bark, in its sole discretion, to have repeatedly violated the intellectual property or other rights of others shall be barred from submitting or posting any further material on TheBark.com.
•Reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of the website, use or access to the website.
•Post unsolicited advertising or unlawfully promote products or services, including sending unsolicited email advertisements.
•Harass, threaten, stalk or intentionally embarrass or cause distress to another person or entity.
•Impersonate another person or entity.
•Promote, solicit, or participate in any multilevel marketing or pyramid schemes.
•Solicit personally identifiable information from or exploit children less than 18 years of age.
•Engage in disruptive activity such as sending multiple messages in an effort to monopolize the forum or posting Content unrelated to a forum’s designated topic or theme.
•Introduce viruses, worms, Trojan horses, harmful code, or any software or other materials that contain a component harmful to the website.
•Gain unauthorized access to any computer system or nonpublic portion of the website or interfere with or disrupt the website, servers or networks connected to the website.
•Invade the privacy of any person, including posting personally identifying or otherwise private or sensitive information about a person without their consent or harvesting personally identifiable information about TheBark.com users through the website.
•Engage in, encourage, advocate, provide instructions for or discuss with the intent to commit conduct that would constitute a criminal or civil offense or otherwise violate any federal, state, local, or international law or regulation.
Digital Millennium Copyright Act (“DMCA”) Notice. In operating the website, we may act as a “services provider” (as defined by DMCA) and offer services as online provider of materials and links to third party websites. As a result, third party materials that we do not own or control may be transmitted, stored, accessed or otherwise made available using the website. International Uses. This website is published in the United States. Information collected on this website is subject to the laws of the United States, and U.S. law shall govern in any and all disputes, including privacy or defamation issues. Your use of this website or submission of information to us constitutes your consent to the transfer of that information from your home country to the U.S.

Notwithstanding the foregoing, we shall be entitled to seek injunctive relief, security, or other equitable remedies from the United States District Court for the Northern District of California or any other court of competent jurisdiction. Under no circumstances shall the arbitrator be authorized to award punitive damages, including but not limited to federal or state statutes permitting multiple or punitive damage awards. Any purported award of punitive or multiple damages shall be beyond the arbitrator’s authority, void, and unenforceable.
Entire Agreement; Severability; Waiver. These Terms constitute the entire agreement between the parties relating to the subject matter herein. If any part of these Terms is held to be unlawful, void, or unenforceable, that part will be deemed severable and shall not affect the validity and enforceability of the remaining provisions. Failure to exercise any right under the Terms shall not be construed as a waiver of such right.
